Work on lifting the ban on assignment in commercial transactions

The RCL website published a draft dated March 9, 2022 (on amendments to the Law on Prevention of Excessive Delays in Commercial Transactions and the Law on Public Finance), according to which it was proposed to add Article 9a, which reads:

"Article 9a. In commercial transactions - with the exception of transactions in which the debtor is a public entity that is a medical entity - the A contractual provision prohibiting a creditor from disposing of a claim, as referred to in Article 509 § 1 of the Act of April 23, 1964. - Civil Code, is invalid.";

The regulations also provide for transitional provisions for business transactions concluded before the date of entry into force of the Act (application of existing regulations with certain exceptions for public procurement).
